Terms of Service for Mural Projects

These Terms of Service (“Terms”) apply to all mural design and painting services (“Services”) provided by Designs by NKJ (“Artist,” “I,” or “me”). By commissioning a mural or signing a Statement of Work (“SOW”), the client (“Client,” “you,” or “your”) agrees to these Terms. In the event of a conflict between the Statement of Work and these Terms, these Terms will govern.
1. Scope of Work
All project details — including concept, size, location, materials, design style, timeline, and cost — will be outlined in the separate written proposal and Statement of Work (SOW). Work will begin only after the SOW or written proposal is signed and any required deposit is received.
2. Payment Terms
Unless otherwise set forth in the SOW, a 50% deposit is due upon signing the SOW, and 50% is due upon completion of the project.Accepted payment methods are as set forth in the SOW. Fees are exclusive of any sales tax or similar tariffs or taxes, if applicable, and Client is responsible for payment of any such taxes placed on the payment. Late payments may incur a late fee of 1.5% per week after the due date.
3. Design Process and Revisions
Artist will provide sketches or digital mockups for approval before painting begins. The design process includes one concept and up to two minor revisions to the design. Once the design is approved, the design can be refined through one round of additional revisions, if needed, before painting begins. Once painting has begun, any design changes may incur additional costs or require changes to pricing or timeline, and major changes will be subject to a change order.
4. Timeline
Most murals take about a week or less to complete. Larger or more complex murals may take longer, and if site access is delayed by Client, the completion date may be extended. Weather or environmental factors may affect outdoor project schedules.
5. Maintenance
Indoor murals can last indefinitely; outdoor murals typically last 10–15 years if sealed properly. However, in no event will Artist be responsible for fading, peeling, or damage that occurs after completion, or any alterations of the mural by any person other than Artist.Future touch-ups, repairs, or restorations can be arranged as a separate service.
6. Client Responsibilities
Client agrees to ensure legal and access to the mural site, and obtain in advance any necessary permits, permissions, or approvals. Client further agrees to ensure that the wall surface is clean, accessible, and free from obstruction for the duration of the project, including by moving large furniture or decor away from the mural area prior to start and by providing access to electricity and adequate lighting, and to protect the mural area from damage during and after installation.
7. Cancellations and Rescheduling
Deposits are non-refundable. If the project is canceled after the design work has begun, the deposit will be retained to cover time and materials. If the project is canceled after painting has started, Client will further be responsible for payment for materials purchased and work completed to date.
8. Ownership and Usage Rights
Artist retains copyright and design ownership of the mural and may use photos and images of the mural for portfolio, website, social media, or other promotional purposes on an anonymized basis. Client receives full rights to display the mural on location following payment in full. Client is encouraged to share photos on social media and tag @DesignsByNKJ.
9. Limitation of Liability; Indemnification
Artist will take reasonable precautions to ensure safety and protect property during the project. However, Artist shall not be liable to Client for any damage or injury beyond Artist’s control, and Client agrees to indemnify and hold Artist harmless for any damage or injury beyond Artist’s control (e.g. vandalism, site hazards). In no event shall Artist be liable to Client for amounts in excess of amounts paid under the applicable SOW, subject to any limitations under applicable law.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any disputes will be handled in the courts located in Raleigh, North Carolina, provided that if a disagreement arises, both parties agree to first try to resolve it informally through good-faith communication. If that doesn’t work, disputes may be settled through mediation or small claims court rather than formal litigation whenever possible.
11. Miscellaneous
The Artist is not responsible for delays or failures caused by events beyond the Artist’s reasonable control (such as severe weather, natural disasters, illness, or acts of government). If the Artist chooses not to enforce a part of these Terms at any time, it doesn’t mean that part is permanently waived. The Artist may use one or more subcontractors to perform all or any part of the Statement of Work at the Artist’s discretion, so long as Artist retains liability for the acts and omissions of the subcontractors.
These Terms, together with the Statement of Work, represent the entire agreement between the Artist and Client. They replace any prior discussions, emails, or proposals about the same project. Any changes to these Terms or the SOW must be in writing and agreed to by both parties. If any part of these Terms is found to be invalid or unenforceable, the rest will still apply.
